Myra Contest
Premise
Myra Srl, a company committed to creating added value through activities with a high social impact, is proud to announce the first edition of the Myra Contest (hereinafter only "Initiative"). This unique initiative aims to enhance the excellence and uniqueness of the manual skills of blind and visually impaired people in the field of jewelry design. With this contest, Myra Srl aims to demonstrate how vision is not the only means to create beauty, challenging participants to explore new frontiers of the art of jewelry through touch and perception.
Recognizing the unique challenges that visually impaired designers may face, Myra will provide comprehensive support to participants. This support includes not only access to materials and tools specifically tailored to their needs, but also assistance and training in designing and implementing their designs.
The "Gioielli al Buio" contest is open to all those who, despite blindness or low vision, wish to explore their talent in jewelry design, offering a platform to showcase their work to a wider audience and to celebrate the uniqueness of their perspectives. With the aim of creating an inclusive community that recognizes and values the diversity of talents, Myra Srl invites all interested parties to participate in this creative adventure.
- Promoter
The Promoter of the Initiative is the company Myra Srl with headquarters in Via Firenze, 21 – Sesto San Giovanni (MI).
- Beneficiaries
The call is open to all natural persons of age who are passionate about design and who are blind or visually impaired pursuant to art. 6 L. n. 138 of 3 April 2001.
Participation is free and each candidate can present only one jewelry design to the jury. Given the organization of the initiative that provides constant assistance in the process of realization of the staff of Myra Srl, only the first 15 candidates who, in chronological order, will send their registration will be able to participate.
- Duration of the Initiative and methods of participation
The initiative begins on April 23, 2024 with the launch of the Call and will end on May 12, 2023 , with the Final Event to announce the winners.
Applications must be submitted by 23.59 CET on 08 May 2023 , using the form available on the dedicated page published on the website www.myra-lab.com (hereinafter “Website”). If difficulties are encountered during the registration phase, those who wish to submit their application can contact the number 3477928655 to receive support in registration (from Mon. to Fri. from 09:00 to 17:00).
All useful information of an organizational nature will be published on the Website. For organizational reasons and technical needs, the Promoters reserve the right to make the necessary changes to the dates and times of the events connected to the Initiative, after notifying the Participants through all the channels used for advertising the Initiative.
Participation in the Initiative does not imply, for the Promoters, any obligation or commitment of any nature other than that provided for in this Regulation, which the Participants, by signing this Regulation, confirm to know and respect.
By submitting their application, Participants unconditionally accept the decisions that will be taken by the evaluation committee regarding the selection of the winning projects, as defined below.
Any activity related to the participation in this call is the sole responsibility of the participants. No compensation or reimbursement of any kind is foreseen for the production of documents, installations and prototypes, nor for travel, accommodation and anything else in relation to the presentation of the application and participation in the selection process.
The documentation transmitted for the purpose of participation in the Initiative will not be returned.
- Implementation of the Initiative
The Contest will take place through the manipulation of a malleable product provided directly by the Promoter, who, thanks to the help of Myra Srl staff who will follow and assist the participants in the modeling, the candidates will be able to express their creativity and talent in creating the jewels. Only jewelry designs created specifically during the prototyping day-event and with the material provided by Myra Srl may be candidates.
The creations, i.e. the jewelry designs made with the manipulation of the malleable product provided by the Promoter, presented for selection to the Jury by the participants, will be returned to their authors at the final event, except for those selected pursuant to the following art. 7. If the participant who has nominated his/her creation cannot be present on the day on which the creations are returned, he/she may request within 30 (thirty) days of the final event, via the dedicated page within the Website, to receive the creation at his/her home, at his/her own expense.
- Contest Dates and Locations
The initiative will start on Tuesday 23 April 2024 and will end with the final day on Sunday 12 May 2024. The Initiative's programme is divided as follows:
Launch Day: 04/23/2024 – Rules published
The main activities planned for this day are:
- presentation of the operating methods for carrying out the Event;
- Registration opens.
Prototyping Day: 11/05/2024 at "Temple of the Lost Future" – Via Luigi Nono, 7 - 20154
The planned activities are:
- candidate registration;
- explanation of the use of the tools;
- jewelry making workshop.
Final Event: 12/0 5/2024, from 09:00 to 14:00 – In-person event* at "Tempio del Futuro Perduto” – Via Luigi Nono, 7 - 20154
The activities planned for this day are:
- jury evaluation and awards.
- Representations and Warranties on the Jewellery Design Presented
Each participant, upon registration and delivery of the jewellery design model to the Promoters, declares and guarantees, for all legal purposes and aware of the resulting civil and criminal responsibilities:
- To be the author and exclusive creator of the design, drawing, project or model presented, in all its parts, as well as to hold all the rights relating to the same.
- That the submitted design, including its individual parts, has never been produced, patented, and does not violate any third party rights, including but not limited to violations such as counterfeiting, unfair competition, copyright infringement, or other forms of infringement of rights.
- That the design and/or media used do not violate any criminally relevant laws, including but not limited to images, videos or content that may constitute advertising and/or defamation of brands or products of third parties, harmful to the dignity of the person, containing images and/or messages alluding to immoral, illicit or illegitimate actions, or involving the use of minors.
- To assume full responsibility for the above-mentioned requirements, declaring himself/herself exclusively responsible towards Myra Srl and third parties for the declarations made, and expressly indemnifying the promoters and partners of the initiative from any request, including that for damages, which could be advanced by the author, the rights holder, or by third parties entitled thereto.
Furthermore, if the design of the presented jewel is found to lack even one of the above requirements, such project will be excluded from the Initiative. This includes, by way of example, the use of third-party trademarks without the necessary authorization.
Furthermore, the participants whose jewellery design model will be selected pursuant to art. 7, must declare:
- To accept that if, once the design, drawing/project/model has been published, Myra Srl receives reports documenting the existence of prior rights of third parties and the violation of these by the design/project/model or a part of it, Myra Srl may, after verification and at its sole discretion, terminate this contract with the consequent request for any damages.
- To be aware of the purposes of creation/production, communication and marketing of the designs selected by Myra srl. Furthermore, to encourage the increase and participation in upcoming events, the company Myra Srl has the right to publish through its social channels and on the website, or with any other means, disclose the images of the drawings/projects/models as it deems most appropriate for achieving the purpose.
- Selection, Transfer of Rights, Production, Marketing
Among the jewelry design models presented by the Participants in the initiative, some of them will be selected by the Jury in order to be prototyped and marketed through the distribution channels of Myra Srl.
The Participant who submitted the selected design will be indicated as the author (hereinafter "Author") of the jewel design, in all communications made by Myra Srl. Each sale made through Myra Srl's distribution channels will generate a royalty for the author, better described in the following art. 9.
By applying for the competition, participants accept that, in the event of selection, Myra Srl may exercise a right of option, as indicated in the following art. 8, in order to acquire the rights to the economic exploitation of the jewellery design models selected by the jury, necessary for the prototyping and marketing of the same. The Participant declares to acknowledge and accept that, if the aforementioned right of option is exercised, the following agreements will apply in relation to the rights to exploit the design of the jewellery presented and to any industrial property rights relating to the design of the jewellery itself (with reference to the brand and the design) which will be selected for the purposes of production and marketing.
By virtue of this regulation and the acceptance of the contractual terms, the participants whose jewellery design model has been selected (also only “Selected Participants”), assign to Myra Srl:
- for all legal purposes, upon payment according to the methods indicated below, the exclusive exploitation of the work created by him for the material reproduction (art.13 la), without limits of quantity, also through 3D printing technology, of the drawing/design of the jewel/model sent by the designer, or of a part thereof, and this for the distribution, marketing, circulation (art.17 la) and sale of the product to the public, by means of the trading platform that will be identified and/or online sites connected to Myra Srl, without any territorial limits;
- the right for Myra Srl to proceed with the protection of any intellectual property rights relating and connected to the design of the jewel, by carrying out the relevant registrations (of trademark and model, Italian and/or community) in its name and account, without prejudice to the right of the Author, as licensor, to be indicated as the author of the design/design of the jewel/model registered. Myra Srl will fully bear any filing costs.
Furthermore, each of the “selected” Participants undertakes:
- not to deposit and/or have deposited by third parties referable to them the intellectual property titles arising from the design of the jewel and connected to it;
- to indemnify Myra Srl from any claim – including for compensation for damages – made by third parties in relation to the design of the jewel and its components and this by virtue of the guarantees provided pursuant to the previous art.6;
On the other hand, Myra Srl:
- reserves the right, in any case, to carry out a preliminary market survey before signing the contract and to decide on the possible marketing of the product, at its free and unquestionable discretion;
- reserves the right to disseminate (art.16 la) and advertise through its social channels, or with any other means of dissemination, online, the images of the drawings/designs/models as it deems most appropriate;
- reserves the right to make all necessary changes to the finished product (e.g. color, material, etc.), during the production process, which may be necessary for production and marketing purposes. To this end, Myra Srl, as licensee, may request the Author, or licensor, to make changes to the drawings/designs/models that it deems most appropriate;
- may request to modify, at its sole discretion, the name, or any technical instructions, of the design of the jewel/model for commercial purposes;
- reserves the right to withdraw the product from the market, at its sole discretion, at any time.
All the provisions of this article are subject to the actual selection of the design of the candidate jewel and are binding, from the moment of acceptance of the Regulations, only on the participants who are authors of the design of the jewels selected by the Jury.
- Option right
The Participant, declaring to adhere to this Regulation by registering for the event, recognizes Myra Srl's right to acquire ownership of ideas, know-how, innovative solutions and, in general, of all the results achieved within the scope of the Contest activities and presented in the designs of the models delivered, if the Promoter expresses its will to this effect within 45 (forty-five) days from the date on which it received the results from the jury.
Until this deadline has passed, Participants may not transfer ownership of their results to parties other than the Promoter, nor authorize them to use them in any way or disclose them.
The Promoter's intention to acquire ownership of the results must be communicated promptly to the interested Participants.
By adhering to this Regulation, the Participant accepts that within 15 (fifteen) days of the communication of the will to exercise the right of option by Myra Srl, he/she must sign a specific contract that reproduces all the agreements and clauses referred to in the articles of this regulation. For anything not expressly established and agreed here, the Participant may oppose his/her refusal.
By adhering to this Regulation, the Participant declares to accept that the consideration for the exercise of the option right by the Promoter will be represented by the consideration referred to in the following article. The same will be paid directly by the Promoter to a Participant representing the Team that owns the results.
Notwithstanding the preceding paragraph, the Participant agrees not to claim any additional compensation from the Promoter for the exercise of the option right on the results.
- Marketing fees
As consideration for the transfer of the exploitation rights connected to the design/project/model and to the registration rights, Myra Srl undertakes to recognize to the author of the design, an amount as consideration equal to 30% of the turnover relating to the product marketed net of production costs and value added tax (VAT) and shipping costs and for the entire duration of the relative marketing under the Myra Srl brand or its licensees.
The 30% royalty will be paid gross of any cash charges, INPS reimbursement and/or withholding tax, and/or in any case of any other possible charge in the invoice.
For tax purposes, the income received, if not obtained in the exercise of commercial enterprises, can be traced back pursuant to art.53 c.2 letter b DPR 917/86 (TUIR) to income deriving from the economic use, by the author or inventor, of works of the mind, patents, etc. and on which the withholding tax will be applied, taking into account the flat-rate deductions provided for by art.54 c.8 DPR 917/86.
The amounts due to the Author (and in this case the licensor) will be remitted upon request of the same, as soon as the amount has reached the value of Euro 101.00.
These amounts may be consulted by the Author by sending a written request to Myra Srl.
The amounts reported in this way will be paid quarterly, with a 60-day delay from the reference period in which the sale is made.
In any case, all due compensation due to the Author will be paid by December 31st of each year, regardless of the value reached.
- Awards
The participants who have created the best designs selected by the Jury will be awarded with a commemorative plaque of the Contest during the final event of this initiative.
- Permissions
By signing this regulation, the Participant authorizes the Promoters:
- to acquire and use, directly or through third parties, publish and disseminate the images/videos that portray him/her during the Initiative, as well as the audio recordings collected in the same context, without limits of modality (for example web - radio - media television etc.), time and space, in Italy and abroad, with every and widest faculty of adaptation/modification and editing that may be necessary/appropriate. The undersigned, having acknowledged the publication/use of the images that concern him/her in the manner described above, declares that he/she has no claim against the Promoters for damages to his/her name and/or image that may arise from a prejudicial use of the same by third parties. The right to use the images, photographs, films, recordings as specified above, is to be understood as free of charge with express waiver of any and all claims in this regard;

- Jury
The Initiative Jury is made up of members chosen and appointed by the administrative body of Myra Srl, whose names will be made known within 10 days of the date of the event, through a specific publication on the dedicated page of the Website.
The Jury will evaluate considering the conceptual elements of the work presented, the quality of the realization and the opportunity of development of the project also in commercial terms.
In particular, the evaluation will take into account the following criteria:
- Drawing
- Originality
- Marketability
- Usability
The Jury, on the basis of its unquestionable judgment, will select the jewelry design models that it deems most corresponding to the criteria stated and will assign the authors the awards provided for in art. 10 of this regulation. Likewise, it may assign any mentions of merit to those designs that, although particularly significant, are not selected. The Jury may consult technical experts regarding the actual realization of the final product and on any technical issues or questions the Jury has the right to request the intervention of an expert.
The Jury and any person with knowledge of the selection and the mentions awarded, undertake to maintain absolute confidentiality until the publication of the final results of the Initiative.
The Jury may select one or more designs in equal measure.
- Exclusion
Myra Srl will exclude, at its sole discretion, projects that do not comply with the requirements of this regulation. By way of example and not limited to, jewelry designs will be excluded that:
- they were not made inside the contest venues;
- cannot be digitally transferred via a 3D scanning tool and/or make it impossible to produce with SLA/SLS additive 3D printing techniques;
- submitted by individuals registered with a nickname or a fictitious name that cannot be traced back to a natural person;
- that contain images/logos/trademarks registered or belonging to third parties and not authorised for use;
- jewelry design and/or depictions against public morality, decency and public order;
- in all those cases in which Myra Srl - at its sole discretion - finds irregularities not expressly foreseen that could undermine the correct execution of the design evaluation process or the contest activity.

The Promoters will process the personal data of the contact persons indicated by each Participant for the purposes and in the manner set out in Art. 13 of EU Regulation 27 April 2016 n. 679 “General Data Protection Regulation”.

The initiative will be advertised on the websites and social channels of the promoters, on digital newspapers of the partners who may be involved and through the sending of specific promotional communications, sent by the promoters and/or by third parties appointed.
Myra Srl reserves the right to modify, at its own discretion, this Regulation and/or the organizational aspects of the Initiative, with the aim of improving its execution and/or participation, in
compliance with the defined objectives.
- Acceptance of terms and conditions for participation in the Contest
Participation in the Contest presupposes total acceptance of these regulations and the contractual terms that can be viewed upon registration as a participant on the dedicated page on the Website as well as upon registration for the Contest on the day of the event.
DISCLAIMER
This competition of ideas does not constitute a prize-giving event pursuant to art. 6, paragraph 1 of Presidential Decree no. 430 of 26 October 2001 containing the “Regulation concerning the organic revision of the rules governing competitions and prize-giving operations, as well as local draws, pursuant to article 19, paragraph 4, of law no. 449 of 27 December 1997” as the following are not considered to be competitions and prize-giving operations: a) competitions announced for the production of literary, artistic or scientific works, as well as for the presentation of designs or studies in the commercial or industrial field, in which the awarding of the prize to the author of the chosen work has the character of consideration for the performance of work or represents recognition of personal merit or a title of encouragement in the interest of the community.
